A few points:

1. It was legal for Kyle to carry a firearm. It was not a short barrel rifle so he could carry it legally as a 17-year-old.

2. Kyle did not carry the firearm across state lines. The rifle was already in Wisconsin. He did not carry a firearm across state lines.

This is why the judge dismissed the charge.
